I. Standard Business Terms

§ 1 Basic Provisions

  1. These terms and conditions apply to all contracts made between you and us, Milin Impex GmbH, as the supplier, via the platform Homejame GmbH (https://www.homejame.com). Unless otherwise agreed, your own terms and conditions will not be accepted.
  2. The term consumer refers to any natural person who concludes a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity. A business customer is a natural or legal person or a partnership with legal capacity that acts in the course of its commercial or independent professional activity.


§ 2 Contract Conclusion

  1. The subject of the contract is the sale of products.
  2. By listing products on our website, we offer a binding proposal to conclude a sales contract, subject to the conditions listed in the product description.
  3. The contract is concluded via our online shopping cart system as follows:
    • Products intended for purchase are placed in the shopping cart.
    • You can make changes in the cart at any time.
    • After proceeding to checkout, entering your personal, payment, and shipping details, you will see a final summary.
    • If using an instant payment provider, you may be redirected to their website and then returned to our store.
    • Before finalizing your order, you can review and modify all entries.
    • By clicking the "Purchase" button, you accept the offer and a legally binding sales contract is concluded.
  4. If you contact us to request a personalized quote, this does not bind you. We will send a binding offer via email, which you can accept within 5 days.
  5. The order and contract information is sent to you via email. Please ensure your provided email address is correct and that our emails are not blocked by spam filters.


§ 2a Special Provisions for Fresh Fruits and Vegetables

  1. Exclusion from Right of Withdrawal
    Per legal regulations, fresh products(e.g., mangoes) that is perishable is exempt from the 14-day cancellation policy. Please see our Cancellation Policy for more details.
  2. 24-Hour Complaint Window
    Due to the nature of fresh product, any issues (e.g., spoilage or damage) must be reported within 24 hours of delivery. After this time, refunds or replacements cannot be guaranteed.
  3. Storage Responsibility
    Once received, it is your responsibility to store fresh items properly. We recommend inspecting the items immediately upon delivery.


§ 3 Right of Retention & Retention of Title

  1. You may only exercise a right of retention for claims from the same contract.
  2. The goods shall remain our property until full payment is received.


§ 4 Warranty

  1. The statutory warranty rights apply.
  2. Consumers are encouraged (but not required) to inspect the goods upon delivery and notify us and the shipping company immediately of any visible defects or damage.


§ 5 Jurisdiction, Applicable Law

  1. German law applies. This only affects consumers if it does not override mandatory consumer protections in their country of residence.
  2. If you are a business, our place of business is the jurisdiction and place of performance. The same applies if you have no general jurisdiction in Germany or the EU.
  3. The UN Convention on Contracts for the International Sale of Goods does not apply.

5. Prices and Payment

  1. All prices include VAT and are total prices.
  2. Shipping costs are shown separately and are borne by the customer unless otherwise stated.
  3. Payment methods are shown during checkout.
  4. Payments are due immediately unless otherwise stated.


6. Delivery Conditions

  1. Delivery times and restrictions are listed on the product pages and during checkout.
  2. Risk transfers to the consumer upon delivery. If you arrange your own shipping, the risk passes to you once the product leaves our warehouse.


7. Youth Protection

In accordance with German law:

  • No alcohol may be sold to persons under 16.
  • Spirits and strong alcoholic beverages may only be sold to those over 18.
